There is hereby adopted and incorporated by reference, for the purpose of establishing minimum standards, rules and regulations for the construction, alteration, removal, demolition, equipment, use and occupancy of buildings and structures in the city the International Building Code, 2006 edition promulgated and published by the International Code Council, Inc. Such codes being made a part of the ordinances of the code of the city as if the same had been set out in full herein, all as authorized and in the manner prescribed by K.S.A. 12-3009 through 12-3012. Except that, Section 105.2 Number 2 of the International Building Code, shall not be included in or become a part of this code. At least one copy shall be marked or stamped “Official Copy as Incorporated by the Code of the City of Lakin,” and shall be filed with the city clerk to be open for inspection and available to the public at all reasonable hours of business.

The minimum depth of footings shall be 32” below finish grade and constructed on undisturbed soil and be double formed. This provision is to replace all references to the frost line as referred to in Section 1805.2 in the building code. EXCEPTION: Trenches in hard pan soil are permissible.
Exceptions:
(a) Foundation walls on attached garages using brick veneer may be 8” thick and upper portion may be reduced to 4” to permit a brick ledge. When the 4” portion exceeds 8” in height reinforcing shall be used-maximum height shall be 12”.
(b) Unattached accessory buildings. Type IV or V, Group M occupancy of 120 square feet or less do not require foundation or concrete floor.
(c) Unattached accessory buildings. Type IV or V, Group M occupancy exceeding 120 square feet but not exceeding 180 square feet will require a minimum 4” concrete slab with 6 X 6 10/10 mesh.
(d) Unattached accessory buildings, greater than 180 square feet in area, Type IV or V, Group M occupancy, wood frame only, monolithic pour, may have a foundation consisting of the following:
(1) 6” X 32” trench in hardpan soil.
(2) One 1/2” rebar horizontally located in center of trench with 1/2” rebar uprights located 48” o.c. being bent over into floor a minimum of 24”.
(3) Where interior of trench meets 4” floor the fill shall be removed to provide an increased thickness not less than 6” below bottom of floor and not less than 6” from interior wall of trench producing a 45 degree angle.
(4) 6 X 6 10/10 mesh required in floor to be tied to rebar.
(5) Maximum size of building not to exceed 24’ in width and/or 32’ in length.
(6) Maximum rafter span shall not exceed 24’.
(e) Unattached accessory buildings, greater than 180 square feet in area, Type IV or V, Group M occupancy, wood frame only, stem wall and floor poured separately, may have a foundation consisting of the following:
(1) 8” X 32” trench in hardpan soil, with bottom of trench flared, 8” high and 3” wide on each side of trench.
(2) One 1/2” rebar horizontal and continuously 24” on center located in center of trench with 1/2” rebar uprights located 48” on center.
(3) 6 X 6 10/10 mesh required in floor.
(4) Maximum size of building not to exceed 24’ in width and/or 32’ in length.
(5) Maximum rafter span shall not exceed 24’.
FOOTINGS AND FOUNDATIONS FOR STUD BEARING WALLS
(Of Hollow Masonry Units Sand and Gravel, Expanded Shale or Similar Aggregates)
(1) The minimum depth of footings shall be 32” below finish grade and constructed on undisturbed soil and shall be double formed. EXCEPTION--Trenches in hard pan soil are permissible.
(2) Maximum depth below finish grade 48”
(3) Maximum depth below finish grade 84”
* Last continuous course of all walls shall be a bond beam
* Where Hollow Masonry Units are decreased in thickness there shall be a course of solid masonry interposed between the wall below and the thinner wall above or the Hollow Units in the top course of the thicker wall shall be filled solidly with Portland concrete.
(a) Minimum lap of reinforcing bars shall be 15 inches.
(b) Welded or mechanical connections shall develop the strength of the reinforcement.

(a) Municipality: The City of Lakin;
(b) City Inspector: Shall be held to mean the building official of the city, or some other city officer or employee as shall be designated by the mayor and council.
(c) Homeowner: A person who owns the home he or she lives in.

(a) Generally. A building contractor for the purposes of this article shall be:
(1) Any person, whether a resident of the city or not, who undertakes with or for another, for a fixed sum price, fee or any compensation other than wages, to build, construct, alter, repair, add to, wreck or move any building or structure (or any portion thereof) or any sidewalk, driveway entrance or structure in any street, or any other structure in the city for which a building or construction permit may now or hereafter be required by resolution or ordinance; or
(2) Who builds, constructs, alters, adds to or wrecks any buildings or structures either on his or her own or other property for purposes of sale or speculation, except one-and two-family residences and buildings or structures accessory thereto and intended for his or her own personal use and permanent occupancy; or
(3) Who advertises or represents himself or herself to the public to have a capacity or ability to undertake or submit a bid or offer to build, construct, alter, repair, add to or wreck, remove, restore or replace any building, structure or construction work or any portion thereof.
(b) Exclusions. The building contractor as defined above shall not mean or include
(1) Any subcontractor working under the supervision of a general contractor.
(2) Any plumber, electrician, mechanical installer or other specialized occupation for which special licenses or bonds are required.
(3) A homeowner building his or her own home, making additions or performing repairs under an authorized building permit.

The city inspector, upon notification from the permit holder or his agent, shall make the following inspections and shall either approve that portion of the construction as completed or shall notify the permit holder or his agent wherein the same fails to comply with this code:
(a) Stakeout: Prior to excavations of any footings or foundations for any new structure or addition, a stakeout inspection shall be required. The stakeout shall reveal all property pins and the exterior boundaries of all structures and additions. In the event that a property pin cannot be located or does not exist, a survey of the lot may be required by the building official to verify that the structure is located in accordance with the approved plans.
(b) Framework: Reinforcing steel or structural framework of any part of any building or structure shall not be covered or concealed without first obtaining the approval of the City Inspector. The building official, upon notification from the permit holder or his agent, shall make the following inspections and shall either approve that portion of the construction as completed or shall notify the permit holder or his agent wherein the same fails to comply with this code.
(c) Footing Inspection: To be made after all forms and reinforcing steel is in place.
(d) Foundation Inspection: To be made after all forms and reinforcing steel is in place.
(e) Frame Inspection: To be made after the roof, all framing, fire-blocking, and bracing are in place and all pipes, chimneys, and vents are complete.
(f) Final Inspection: To be made after building is completed and ready for occupancy.
(g) Other Inspections: In addition to the called inspections specified above, the building official may make or require other inspections of any construction work to ascertain compliance with the provisions of this code and other laws which are enforced by the code enforcement agency.

There is hereby adopted and incorporated by reference, for the purpose of regulating and governing the construction, alteration, movement, enlargement, replacement, repair, equipment, location, removal and demolition of detached one and two family dwellings and multiple single family dwellings (townhouses) not more than three stories in height with separate means of egress, and providing for the issuance of permits and collection of fees therefor, the International Building Code, 2006 edition promulgated and published by the International Code Council, Inc. Such code being made a part of the ordinances of the code of the city as if the same had been set out in full herein, all as authorized and in the manner prescribed by K.S.A. 12-3009 through 12-3012. At least once copy shall be marked or stamped “Official Copy as Incorporated by the Code of the City of Lakin,” and shall be filed with the city clerk to be open for inspection and available to the public at all reasonable hours of business.
