The swimming pool complex of the city shall be operated by a department known as the “Lakin Municipal Swimming Pool.” The department shall consist of the governing body, a manager and other officers and employees of the city who shall devote all or part of their time to the department. The city administrator shall maintain, manage, conduct and control the swimming pool and department. The governing body shall make all such ordinances, rules and regulations as may be necessary for the safe, economical and efficient management of the swimming pools.

There is hereby created the position of pool manager. The manager of the swimming pools shall be employed by the city administrator and shall perform the following duties:
(a) He or she shall have general control and charge of the maintenance and operation of the city’s swimming pools.
(b) He or she shall report monthly to the city administrator on all matters concerning the swimming pool.
(c) He or she shall file an annual inventory of all property with the city administrator.
(d) He or she shall have charge and control of all employees within his or her department subject only to direct instructions from the city administrator.
(e) He or she shall make budget recommendations to the city administrator.
(f) He or she shall work with the city administrator to implement any programs or trainings necessary for the safe, economical and efficient management of the swimming pool.
(g) He or she shall perform all other duties imposed upon him or her by ordinance or law.

There is hereby created the position of assistant manager. The assistant manager shall be employed by the city administrator and shall perform the following duties:
(a) He or she shall, under the supervision of the city administrator and pool manager, have general control and charge of the maintenance and operation of the city swimming pools.
(b) He or she shall assist the pool manager in the organization and administration of staff, programs, and trainings within the pool department.

All users of the swimming pool for the purpose of this article classified and charged as follows:

Annual fees shall expire December 31 of each year and daily fees will be charged to all other patrons.

It shall be unlawful for any person to enter the enclosure or fence of the swimming pool of the city in any other manner than through the gate or entrance provided therefore, or to climb on or over the fence forming the enclosure, or to enter the enclosure at any other time than when the pool is open for admittance to any such person, except by the authority and consent of the duly authorized officers of the city.

It shall be the duty of the city administrator, pool manager, or person in charge of the swimming pool to prepare a set of rules and regulations governing its use not contrary to the provisions of this article which shall control the use of the swimming pool, the dressing rooms and the grounds adjoining thereto, and the conduct of persons therein, and such rules shall be submitted to the governing body of the city for their approval. After the approval of the regulations, the same shall be printed and posted in conspicuous places about the swimming pool complex. Any person who shall violate the same rules shall be subject to disciplinary action, including being refused admission to or be removed from the pool complex, and shall not be entitled to any refunds of fees paid in advance.

The pool is available to rent for private use by persons residing in Kearny County. The pool shall be closed to the public during the established rental times. Patrons renting the facility shall follow the same rules and regulations governing the operation of the pool complex, having no additional rights than patrons who use the facility during normal operating hours. The following fees apply to all pool rentals:
$40 per hour for all parties with less than 25 participants.
$60 per hour for all parties with less than 50 participants.
$80 per hour for all parties with up to 65 participants.
The minimum charge for the rental of the pool shall be two times the hourly rate established.
