A CHARTER ORDINANCE OF THE CITY OF LAKIN, KANSAS, EXEMPTING THE CITY FROM K.S.A. 15-209 RELATING TO THE RESIDENCY OF ELECTED OFFICIALS AND EMPLOYEES OF THE CITY; PROVIDING SUBSTITUTE AND ADDITIONAL PROVISIONS; AND REPEALING CHARTER ORDINANCE NO. 8.

BE IT ORDAINED by the Governing Body of the City of Lakin, Kansas:

SECTION 1.  Exemption from Statute

       The City of Lakin, Kansas (city), by virtue of the power vested in it by Article 12, Section 5 of the Constitution of the State of Kansas, hereby elects to and does exempt itself and make inapplicable to it, K.S.A. 15-209, which applies to the city, but is part of an enactment which does not apply uniformly to all cities in the State of Kansas.

SECTION 2. Residency; Officers and Employees

(a)   All employees of the city, including those appointed pursuant to K.S.A. 15-209, except as noted in subsection (d), may reside outside the city limits of the city, but they shall reside within Kearny County, Kansas.

(b)   Employees with the public works department (street, electric, water, and sewer) shall reside within a ten (10) minute response time, in all weather conditions, to the city.

(c)   The city attorney may be a non-resident of Kearny County, but shall live in the State of Kansas.

(d)   The city administrator shall be a resident of the city.

(e)   The mayor and all council members shall be residents of the city.

SECTION 3. Codified

       Charter Ordinance No. 10 shall also be codified in section 1-305 of the Code of the City of Lakin, Kansas.

SECTION 4.  Repeal

       Charter Ordinance No. 8 is repealed upon Charter Ordinance No. 10 becoming effective.
