A CHARTER ORDINANCE OF THE CITY OF LAKIN, KANSAS, EXEMPTING THE CITY OF LAKIN, KANSAS, FROM K.S.A. 15-209 AND REPEALING CHARTER ORD. 7 OF THE 1996 CODE OF THE CITY OF LAKIN, KANSAS, PERTAINING TO THE RESIDENCY OF CITY OFFICERS AND EMPLOYEES.
Section 1. The
City of Lakin, Kansas, mayor-council city of the third class, by the power
invested in it by Article 12, Section 5 of the Constitution of the State of
Kansas, elects to and hereby exempts itself from and makes inapplicable to it
K.S.A. 15-209 which applies uniformly only to cities of the third class and
elects to and hereby does provide substitute and additional provisions as
hereinafter set out.
Section 2.
(a) City employees and officers, including
those appointed pursuant to K.S.A. 15-209 may reside outside the city limits of
the City of Lakin, but within the territorial boundaries of Kearny County,
Kansas.
(b) Employees with the public works
department shall live within a 10 minute response time in all weather
conditions. Failure of an employee to respond within the necessary time frame
may be cause for discipline and/or termination of employment. Public works
department shall include the employees of the street department, electric
department, water department, and the sewer department.
(c) The city attorney may be a non-resident
of the county, but must live in the State of Kansas.
(d) The city administrator and city clerk
must be a resident of the city.
