A CHARTER ORDINANCE OF THE CITY OF LAKIN, KANSAS, EXEMPTING THE CITY FROM THE PROVISIONS OF K.S.A. 12-4203 AND PROVIDING SUBSTITUTE AND ADDITIONAL PROVISIONS ON THE SAME SUBJECT PERTAINING TO THE SERVICE OF MUNICIPAL COURT COMPLAINTS, NOTICES TO APPEAR, AND WARRANTS.

BE IT ORDAINED by the Governing Body of the City of Lakin, Kansas:

SECTION 1. Exemption from Statute.

The City of Lakin, Kansas ("City"), by virtue of the power vested in it by Article 12, Section 5 of the Constitution of the State of Kansas, hereby elects to and does exempt itself and make inapplicable to it, K.S.A. 12-4203, which applies to the City but is part of an enactment that does not apply uniformly to all cities in the State of Kansas, and hereby provides substitute and additional provisions on the same subject as hereinafter provided.

SECTION 2. Substitute and Additional Provisions.

(a)   Any complaint, together with a notice to appear or a warrant, that is or will be filed in the Municipal Court shall be served upon the accused person by any person or position designated by ordinance.

(b)   Any complaint, notice to appear, or warrant set forth in subsection (a) shall be served in the manner prescribed by ordinance.

(c)   Nothing herein shall limit, restrict, or prohibit the City from enacting one or more ordinances that provides the same, substitute, or additional provisions of K.S.A. 12-4203, and amendments thereto.

SECTION 3. Severability.

If any section, clause, sentence, or phrase of this charter ordinance is found to be unconstitutional or is otherwise held invalid by any court of competent jurisdiction, it shall not affect the validity of any remaining parts of this charter ordinance.

SECTION 4. Headings; Section References.

The headings used in this charter ordinance are intended for convenience of reference only and shall not affect the interpretation or construction of this charter ordinance or any part hereof.
