CHAPTER 2. ANIMAL CONTROL AND REGULATIONCHAPTER 2. ANIMAL CONTROL AND REGULATION\Article 4. Other Animals.

(a)   It shall be unlaw1ul for any person to keep, maintain or have in his or her possession or under his or her control within the city any poisonous reptile or any other dangerous carnivorous wild animal or reptile, any vicious or dangerous domesticated animal or any other animal or reptile of wild, vicious or dangerous propensities.

(b)   It shall be unlaw1ul for any person to keep, maintain or have in his or her possession or under his or her control within the city any of the following animals:

(1)   Badgers, raccoons and skunks.

(2)   Bears.

(3)   Bobcats, lynxes, pumas, cougars, mountain lions and panthers.

(4)   Crocodilians, 30 inches in length or more.

(5)   Elephants, hippopotami and rhinoceroses.

(6)   Game cocks and other fighting birds.

(7)   Jaguars, leopards, lions, tigers, cheetahs and hyenas.

(8)   Ostriches, emus and rheas.

(9)   All animals of the order Primate, including new and old world monkeys and apes, which includes but is not limited to monkeys, chimpanzees, gibbons gorillas, orangutans, siamangs and baboons.

(10) All poisonous reptiles and animals, including lizards, snakes and rear-fang snakes.

(11) Constrictor snakes, eight (8) feet in length or more.

(12) Swine, except potbelly pigs.

(13) Ungulates, including all members of the deer family, elk, antelope moose, bovine and bison.

(14) Wolves, wolf hybrids 2, domesticated dogs hybridized with wild canines, and coyotes.

(c)   The prohibitions of this section shall not apply to bona fide pet shops, zoos, circuses, carnivals, veterinary clinics in temporary possession of an animal, educational institutions, or medical institutions, if:

(1)   Their location conforms to the provisions of the zoning ordinance of the city.

(2)   All animals and animal quarters are kept in a clean and sanitary condition and so maintained as to eliminate objectionable odors.

(3)   Animals are maintained in quarters so constructed as to prevent their escape.

(d)   Any animal kept, maintained or possessed in violation of this article can be immediately seized by the animal control officer or any law enforcement officer and impounded until disposed of in. accordance with section 2-401(e) or order of the municipal judge. The animal control officer or any law enforcement officer shall have the authority to immediately destroy any animal prohibited by this article which poses a threat to public safety

(e)   Any animal impounded under the provisions of this article may be disposed of by the city to the custody of an institution deemed to possess the skill, expertise, training and facilities to keep such animal and that agrees to comply with all the provisions of this law and any other federal, state or local law or regulation applicable to the keeping of the animal.

Animals excluded from the prohibition in section 2-401 shall be as follows:

(a)   Amphibians.

(b)   Birds.

(c)   Domestic cats, except those hybridized with wild felines.

(d)   Domestic dogs.

(e)   European Ferrets.

(f)   Fish.

(g)   Domesticated hedgehogs.

(h)   Invertebrates.

(i)    Potbelly pigs.

(j)    Rabbits.

(k)   Rodents.

(I)    Nonvenomous snakes less than eight feet in length.

(m)  Turtles, except snapping turtles.
