Article 1. City Elections

The non-partisan election of city officials shall be conducted in all respects as provided by the laws of Kansas governing the holding of city elections.

At all city elections the polls shall be open at 7:00 a.m. and close at 7:00 p.m., unless different hours are set and publicly announced by the county election officer.

(a)   The primary election of city officials shall be held on the first Tuesday in August of every odd numbered year, beginning in August 2017. The general election of city officials shall be held on the Tuesday succeeding the first Monday in November of every odd numbered year, beginning in November 2017. Succeeding elections will be held every two (2) years for all city officials positions whose terms have expired.

(b)   The governing body shall consist of one (1) mayor and five (5) councilmembers. The terms of office for each shall be (4) years, as initially established by the staggered elections of April 1967 and April 1969. To transition from spring to fall elections, the terms of the elected city officials that expire in April 2017, shall expire on the second Monday in January 2018, when the city officials elected in the November 2017 general election take office. Those elected city officials with terms that expire in April 2019, shall expire on the second Monday in January 2020, when the city officials elected in the November 2019 general election take office.

The terms of officers elected shall commence on the second Monday in January following certification of the election, and the elected officers shall qualify by taking the oath or affirmation of office to be filed with the city clerk.

(a)   Any person desiring to become a candidate for city office elected at large in the city shall file with the Kearny County election officer, before the filing deadline, established in K.SA 25-205, and amendments thereto, a declaration of candidacy on a form furnished by the Kearny County election officer, as specified by the secretary of state.

(b)   The filing shall be accompanied by a filing fee of five dollars ($5) or, in lieu of such filing fee, by a petition signed by twenty-five (25) qualified electors of the city, or by a number of such qualified electors of the city equal to not less than ten percent (10%) of the ballots cast in the city at the last general city election, whichever is less.
